To ensure the effectiveness of flood control facilities, the Water Act was amended in 2018 to include content related to discharge control, and it was implemented from February 1, 2019 

To ensure that land development does not increase the load on downstream waterways, the land developer should bear the increased runoff within the site to ensure that development does not increase the risk of flooding in downstream waterways and nearby areas, and maintain the effectiveness of existing flood control facilities.

Therefore, the Water Act stipulates that for land development and use of a certain scale or above (currently set at 2 hectares, Yilan County and New Taipei City have set it at 1 hectare), which increases runoff, the obligor should submit a discharge control plan to the competent authority of the target enterprise for application, and the competent authority of the target enterprise should forward it to the local government where the land is located for approval.

To implement it, the following Regulations or Standards have been established

 1. Regulations for the Review, Supervision and Exemption of Outflow Control and Proposal

 2. Check Criteria and Calculation Method for Peak Flow of Outflow Control Plan and Proposal

 3. Administrative Charge Standards on Review of Outflow Control Plan and Proposal

 4. Applicable Scope and Capacity Standards for Buildings Equipped with Permeable, Water Retaining or Flood Detention Facilities
